I think being deceived is different than being raped.No, he has a valid point, if not tactfully or clearly stated. The guy consented to have some type of sex (I assume oral) with (what he considered to be) a woman. He then found out that what happened what not, in fact, what he consented to. A great lawyer could possibly get somewhere with that. However, layered on top of that is the "gay panic" defense, which has been struck down time and again.
