Federal judge strikes down Utah’s ban on same-sex marriage

A federal judge in Utah Friday struck down the state’s ban on same-sex marriage, saying the law violates the U.S. Constitution’s guarantees of equal protection and due process.

"The state’s current laws deny its gay and lesbian citizens their fundamental right to marry and, in so doing, demean the dignity of these same-sex couples for no rational reason," wrote U.S. District Court Judge Robert J. Shelby. "Accordingly, the court finds that these laws are unconstitutional."

Equality is marching forward in Utah. Gayle Ruzicka and her Eagle Forum ilk must be in mourning right now.
 
I predict this ruling stayed, and then will be overturned. We're still, at a minimum, 5 years away from the courts finishing the job, probably more like 15-20.

I see gay marriage as never being passed in places like UT and OK. If it ever is it will not be thru votes but federal/state mandates. Some places are simple to conservative socially.

Well, "never" is a long time, but on their own it could take 40 or so years.

Loving vs. Virginia overturned bans in 13 (or was it 16?) states. Eventually, those states would have repealed their bans. Probably something similar will happen here. When we have 30+ states with gay marriage, SCOTUS will step in and finish the job.

To be honest I just do not see it. Utah will forever be a Mormon dominate state and therefore a very socially conservative state. Recently it feels that the Mormon church is pushing back even harder against what it considers social tendancies toward sin. This never made sense to me from a Christian standpoint. Granted they think it is a sin as they should, but from a Christian standpoint the entire purpose of this life is free agency. What is the point if you try to legislate obedience? I am sure other Christians, in particular Mormons, will see where my line of thinking is headed.

The bolded part to me indicates weakness. An unwillingness by the administration (which ever one is in office at any particular time) to take a stand on a hot button issue and actually lead. That's politicians for you.
 
What else can you expect from an Obama appointed judge?

First polygamy was legalized. Now this?

I think that while Utah is conservative it is less so than the voting booth makes it seem. Liberal people often don't bother to vote in Utah. They either feel that it is pointless or they have a felony pot conviction. I always try to convince people that moral victories are important and that even though they may lose, losing by less than 10% as opposed to losing by 25%+ will soften the other sides position. I also believe that there is a clear demographic trend here. When you speak to people under 40 you get completely different responses on all sorts of issues. I think Utah will be a very different place(politically) in the next 10-20 years. Utah will shift in the same way states like Colorado have shifted.

I do not think so when you have places like BYU and Ricks College in Idaho pumping out extremely socially conservative youth by the thousands.

The states biggest schools are public "liberal" institutions. BYU is far out numbered. Besides BYU I is merely a farm school for the real BYU. Seriously, nobody graduates from BYU I.

UVU alone has like 5-10k more students than BYU. Give it another 10 years and UVU's enrollment will be even greater. BYU's? When has BYU's local enrollment ever increased? They bring in more Koreans or Californians than Utahns.

Probably over 80% of people who attend byui actually graduate from there these days. The days of being a farm for Provo are gone. There are way too many students who want to go to Provo for it to need a farm school. From what I understand it is harder to transfer from Idaho to Provo now.
 
It's Ben a busy week. Not only can I marry my boi toy, but I can marry eight or nine of them if I want. This is so hawt!
 
Polygamy isn't legal. But cohabitation is not illegal. The polygamists getting prosecuted weren't actually trying to get multiple marriage licenses. The government was going after them for living and sleeping with multiple people. Basically the judge said, you can sleep and live with as many people as you want. You still can't marry them all at the courthouse though.
