Valid point. And it's true, prima facie. However, when the stakes are this high, and we already have a candidate who has made it clear he has no problem disregarding the rule of law and using force to try to invalidate the voting populace, any vote that doesn't have a realistic chance of keeping him out of office, is for all intents and purposes a vote that can be used illicitly to give him the office. If the margin of victory isn't sufficiently high, it could lead to bloodshed again. So I would argue in this case it is valid to consider a vote for anyone other than Harris as a vote for Trump.
