Tony Stewart, NASCAR driver, hits and kills a driver who got out of his car.

I actually had someone almost kill me. I was driving a forklift on a truck and the guy in the truck decided to pull away from the dock (it was winter, so the truck was idling as we finalized the load. We transported the forklift to unload the stuff at another warehouse, and the last thing to do was pull in the forklift and shut the trailer door.) Luckily I was able to jump off the forklift and back into the building before it fell off the dock. The driver, having realized what he had done, decided to back up, which destroyed the forklift and truck. I was barely able to scramble back inside before I was crushed by the truck.

Needless to say, I refused to work with the guy after that.
Bro, you gotta lock the truck to the bay/dock and use wheel chocks..... though I know people get in a hurry and take short cuts to save time.

Yes, I know. The driver did chock the wheels (I always checked before loading, and verified the brakes were set.) I actually heard him release the air brakes, that is what gave me enough reaction time to jump off. The guy that moved the truck (he was just pulling the truck in the warehouse for the morning driver) removed the chocks, released the brakes and pulled away. Our dock did not allow the trailer to lock to the dock. It just had standard bumpers.

I can't say I was super cautious about everything, but securing the trailer was always a big one for me. I just thought he was out warming up the diesel engine (it was standard winter protocol). He was supposed to come inside and verify the load was secure. He missed a big step.
 
I trust that Obama and his advisors, and the congressional committees, and the Pent, and every other structure we have in place to deal with this kind of ****, aren't a bunch of Murricah hatin morans and have put in place the best possible solution to the ISIS-Iraq problem.

This might have been an accident on Stewart's part..... more importantly there is no way to prove it was intentional from that video alone

If we grant that Ward (the dude who died) was completely in the wrong for leaving his vehicle and running around on the track does that:

A-Absolve Stewart of failing to take adequate measures to avoid hitting someone or something under a caution flag?

B-Absolve Stewart if his actions were reckless?

C-Absolve Stewart if his actions were aggressive and he was attempting to "send a message" to Ward?

D-Absolve Stewart if he aimed his car at Ward and hit him?

Not aimed at you specifically Fishon, anyone who feels that Ward is at fault because he got out of his car and ran around on the track. At what point could Stewart be held accountable, in part, for Ward's death?

Dock locks, wheel chocks and king-pin locks, which are probably the best of the 3 if you could only choose one.

The problem is we don't know that Stewart didn't do all of that to prevent it, and perhaps none of it to cause it. It just cannot be proven, at least from the video accessible by the public.

Sure, I don't know what he did or didn't do, but there is a significant amount of sentiment out there that Ward essentially got what he deserved. My question is if he deserved it does that absolve Stewart of any wrongdoing no matter what level of culpability he had?

My answer to that is no it does not absolve him, but it may create a situation in which his culpability will never be known and/or prosecuted, even if he willfully and gleefully tried to run the guy down.
