Trey Burke is getting sued

No way this dude has a case. Athletes will probably settle outside of court just to avoid the embarrassment, and I'm sure this dude knows that.
 
Mr. McGibbles and stiches, I respect your guys' opinions, and admittedly don't know much about the law. The most I've done is taken the LSAT and scored well enough to meet admission standards of a few schools I am interwsted in. Truthfully, the LSAT is just an aptitude test, not a test of knowledge.

With that said, I am perplexed as to why you negged me Mr. McGibbles. I never said Binion would win his case, I just said he had the bones of a case, which obviously hinges on my understanding. I don't know every angle of the argument that Binion's lawyer would be crafting, but it obviously goes well beyond a levied insult and hurt feelings, which some on here are trying to simplify it to.

At the end, the Officer was like, You said you're going to see your girlfriend in Lavalette? I said yes, and he told me I could leave my car on the side of the road there and that he'd drive me to her place and that she could bring me to the station in the morning to get my keys, and then my car.

I've met a few cops that have that same policy as long as you weren't driving like a maniac, act respectful towards them and you were honest that you had been drinking.

The first posters to make any sense were you and stiches, who came after the post you negged (post #31).

Also, I didn't make any emotional appeals. If I am correct in assuming what you are interpreting as an emotional appeal (post #27), you are incorrect. The post is a retort of example to Stoked's erroneous examples that illustrated his understanding of what this case would be about/and future precedents that would be set. Stoked originally made erroneous claims about what grievances in his own life he could sue for, assuming that his claims were the same as Binion's. I mentioned my disability, not as a cheap emotional ploy, but to demonstrate what the difference between verbal and fully legal discrimination (linguistically) from possible defamation could be. That is all.

I am a libertarian myself. I whole heartedly support free speech. People can level as many insults as they want at me, and I at them. If this case went to trial, it would be about defamation, which is illegal. No new precedent. Does Binion hve enough of a case to win on defamation? I don't know, but I do see how he has the makings of a case, and I can also see how he can lose.

I just didn't like people's over-simplification of this suit.

He has no chance of getting a ruling in his favor.

Like has been said before, probably the only reason he's doing this is because a lawyer convinced him that the rich athletes will give him money before the process gets any further because they feel bad. So he and the lawyer will get paid. It's a worthwhile thing to do.

If I was Burke I'd call his bluff and let him take his suit as far as he possibly can, which likely wouldn't be very far. Really dumb and disgusting what Trey did, but he sincerely apologized, and I'd assume he learned from this situation. He doesn't owe him anything more. Any money that Binion gets from him would be nothing but charity, and I'd rather give out my charity to people who aren't *******, and would definitely avoid rewarding anyone who threatens with a lawsuit (that behavior is pretty out of control). But then again, I'm what many would call a gigantic *******.

The chance and validity of greivances and damages claimed is for the courts to decide.

I wouldn't sue if I was Binion, especially after accepting the apologies. I don't agree with the behavior, on either side now, I just don't dismiss a case before the arguments have been heard.
 
That is not what is happening here.

The insulting joke was levied publically, thus influencing other's opinions and defaming Binnion's reputation.

What you are referring to is different. As a disabled person myself, insults are levied on the regular, but they are not defaming me because they are not done on public stages by people who hold a great deal of influence to alter my reputation, thus no law has been broken. While I find it repugnant when I am ridiculed and judged for a disability and not the content/merit of my being, I know nothing illegal has taken place. I reserve my right to verbally bitch slap those who come at me like that. That is free speech, and should be protected for both parties.

Defamation is another matter. It is serious, and illegal for a reason. Nothing new is happenng here, except three celebrities who decried Sterling (who broke moral codes and NBA laws, not US laws) were engaging in a more socially acceptable form of the same thing. That, in and of itself was not illegal. Defamation is though, as it has numerous and unforeseeable ramifications on those who have been defamed.

What's your disability?

Agree. It was classless to mock, but not criminal. I'm not an attorney, but I just don't see any basis for this suit. It's a money grab...hoping the three settle to make it go away. I've now turned against the plaintiff and the ambulance chaser he hired to file such a frivolous suit.
 
What I'd like to see in this is a settlement where the defendants all make a contribution to a charity that helps people suffering from the disorder in this case and nobody else (including the plaintiff's attorney) get anything.
