Had he held onto the Clippers for 5-10 more years it could have been worth $3billion. So he is forgoing potential profit the same way as Hogan did with the sponsorship.

But if a private conversation is what lead to him losing the team...

Sounds like that would be hard to prove in court.

No it won't be hard to prove at all. In 2007 (about 10 years ago), the Clippers were worth $285 million (according to Forbes), now it's worth $2 billion, so that's an increase of $1,715 billion or 701% over the course the the last 10 years.


It would be easy for the jury to see that the Clippers would be worth AT LEAST $3billion by 2026.

This case is very interesting. My take is as follows:

What we're learning is that fundamental rights are protected more stridently by the courts when they are exercised responsibly. When you're Woodward and Bernstein cracking huge important lies about the government, the rights of the press are sacrosanct and we trust the notions of editorial independence to determine what is sufficiently newsworthy and therefore protectable.

When you're in the business of publishing sex tapes for prurient and titillating interest, well, the courts don't really think your editorial independence is particularly worth protecting as opposed to the real damage you do to individuals.

That seems fair. With great power comes great responsibility and all that. Gawker may not be content with ruining journalism,they're going to blow up the balances of first amendment jurisprudence by being total human trash too.

Pretty sure he has sued/attempted to sue/or is suing people over that stuff.
 
This story just got better and better. Peter Thiel is hardly a saint, but this truly seems like justice being done to me.

I truly enjoyed Gawker's open letter to Thiel today upon finding out that their article outing him a decade ago sowed the seeds of their destruction and that even if they beat the Hogan rap, they are totally ****ed because they made a very powerful and relentless enemy.

Notable words missing from the open letter: "apologize" "sorry" "mistake" and "we shouldn't have outed you." They are getting what they deserve. They wrote a check their *** couldn't cash. **** em.
