"I foresee a scenario in which Kamala Harris could become the next president without the need for a vote count. Republicans have already signaled that election results may not be tallied. Some red states have passed laws or made preparations to withhold or not release vote counts, leaving no electors to send. This could lead to the decision falling into the hands of the House or, more likely, the Republican-controlled Supreme Court.
In Bush v. Gore, another Republican-majority Supreme Court halted the election process and awarded the presidency to George W. Bush, despite the national vote count favoring Al Gore. What’s stopping them from doing it again? (Where in The Constitution does the Supreme Court have this authority?)
This was Trump’s plan in the previous election, as part of his attempted coup. He ultimately failed, largely because Vice President Pence refused to go along with it.
In the upcoming election, if Republicans stall the vote count; instead of allowing the decision to revert to the House or (Republican) Supreme Court, President Biden, alongside Vice President Harris, could declare Harris the president, mirroring the Supreme Court’s decision in Bush v. Gore. This move could at least cause enough delay to ensure a full vote count, which might ultimately secure a legitimate Kamala Harris presidency anyway.
Recently, the Supreme Court has expanded presidential immunity for official acts, effectively granting powers that could enable dictatorial authority—something Trump openly seeks. With this kind of immunity, the President Biden could weaponize the Department of Justice, further solidifying control."
