The Legacy of the Kobe Bryant Rape Case

It'd be awesome if some of my questions were answered directly.

See the bolded. These details would certainly affect my judgment of Kobe's statement. In posting that, you've left open the possibility that she did consent (explicitly) to some of the encounter. Did she? If so, at what point does she believe she stopped consenting? Did she resist or say 'no'? Or did she simply stop 'actively' participating (still waiting for some clarification on this)? If the latter, could this not leave room for one to honestly believe there was still implicit/active consent? If so, would this still constitute rape AND would recognition of differences in perception still constitute an admission of guilt?

I'm trying to be very careful about talking about the responsibility of both partners in a sexual encounter. I'm also very sensitive about this issue for a variety of reasons (and not, as JG and others might believe/imply, because I've ever been accused of rape or any other sexual assault).

I don't see how Kobe would have agreed with her assessment of the situation if all she did was stopped actively participating. He would have, in my opinion, said that she is lying, that she consented and never didn't and that her insistence that it was not consensual was untrue. Instead he agreed that she saw the sexual encounter as non-consensual.

So maybe Kobe isn't an English major and he spoke incorrectly. Am I 100% confident I know what happened? No. I know very little about what happened. But what I do know is that she claimed she was raped and Kobe agreed that after looking at the evidence that she "belived" it was not consensual. If he wanted to say she consented to most of the sexual encounter but maybe changed her mind then he should have said that. But that's not what he said.

I think what he said leaves room for this possibility. Again, I'd have to look at the details of the case. Kobe was presumably making his comments within that context -- and didn't think he needed to clarify to people who might be reading his comments in ignorance of the details of the encounter a decade later.

Anyway, not sure this detail is terribly important. I don't think Kobe's guilt or admission of guilt has any affect on the culture or incidence of rape (I could be wrong). I think celebrity worship is pretty ****ing stupid, regardless. Kobe's status as a rapist doesn't diminish his accomplishments on a basketball court.

Sure, and I'll just say, I'm assuming he raped her. I'm biased. But assuming that a person who says they were raped was actually raped is a pretty solid bet.

Let's not forget that the exual encounter was, according to both of their versions, pretty violent. Maybe after knowing her for a few minutes he knew she was really into violent sex that resulted in bleeding and her running out of the room distraught.

As much as I wish this could be true, it just isn't. I know of at least 3 women who have accused somebody of rape, but made it up.

First case was a friends ex. This one actually made national news (guy was a QB at Montana.) He seemed like a real prick, but he didn't rape her.

Second case was a childhood friend. Girl lied so that her boyfriend wouldn't get mad at her. I'm not joking either.

Third case was two individuals I don't know personally, but it's a small town. He was a teacher, she was a student, she accused him of some things, he had to resign. Month or two later, she admits she made the whole thing up. So this guy gets his name tarnished for nothing. Pretty awesome.

Now I'm not saying women don't get raped, they obviously do. I just wish some of these women realized their false accusations hurt the women who actually do get raped.

I'm not saying that it's common, but to blindly believe an accuser is foolish, IMO. Call them anecdotes all you want, and they certainly are, but I'm sure most people know of situations like this.
 
So let's move away from my assertion that Kobe's statement amounts to a confession. The article posted in the OP talks about the way the media and Kobe's lawyers trashed the victim to the point that she dropped the case and moved out of her hometown.

They did all the classic stuff. Basically said she was too much of a slut to believe that she could have been raped, I mean, you're a skeezy slut who sleeps with half the losers in your hometown but you're gonna say no to one of the biggest NBA stars of all time? Righ?

They asked if the injuries to her genitals might have been caused by having sex with three men in three days, as if genitals are more prone to injury based on the number of men you have sex with. Because if you just have sex with the same guy three times in three days you don't get those kinds of injuries, only nasty hookers get those kinds of injuries.

People asking for Kobe to be shown some respect while trashing the victim relentlessly.

Let's not forget, Kobe had an infant at home. A wife who was caring for a child she had just recently borne. Consensual or not he's a pretty huge scumbag. But let's give him a pass because boys will be boys and nasty sluts will obviously be nasty sluts.

The sex lives of both Kobe and the victim are absolutely none of my business. What purpose does judging either of them serve?

Maybe none. However, Kobe's wife didn't sign up for the added risk of STDs and apparently believed she was in a monogamous relationship. I don't really care what people do, sexually or otherwise, but as I've expressed in this thread, I do care if all the parties involved consent.
