This is true, can't deter everyone but maybe some can be deterred by not allowing penis in women's bathrooms.

If you get caught doing something pervy then you'll get in trouble regardless. There are laws against such things. Doesn't matter what gender you claim.

My guess is quite likely. There are a lot of perverted men out there that will go to great lengths to do horrible things even with the law against them..... There are also some our there that fear getting caught and punished and so they keep their horrible desires at bay. Give them a free pass into womens bathrooms? I'm betting they gonna take full advantage. But hey, molesters are people to right? Who are we to judge them for how they feel and for their desires right? Wouldn't want to offend or restrict the child molesters now would we?

How would you get caught? Again, who's checking for penises and how? Women don't use urinals but stalls. And don't quote me on this, but from my limited experience with women, they often go to the bathroom with no intention of using the actual toilet. Short of you whipping it out at the mirror and pleasuring yourself in full view of everyone, I'm not sure how you'd get caught. And as [MENTION=62]JazzGal[/MENTION] pointed out, if you do that, you'll be in trouble regardless of your gender identification and what bathroom you're in.

But If penises are allowed in women's bathrooms and I go into one and start peeping at women and get caught then I simply say that I wasn't peeping and the accuser was mistaken and I feel like I'm being discriminated against and attacked as a transgender person and I didn't do anything wrong.
Then everyone apologizes to me and I get to do it some more.

If penises are not allowed in there then I have no defense for peeping at women in their bathroom.

You have an extremely ignorant view of gender in general if you think one could use that as an excuse and have it pass muster. Gender identity doesn't work as "I think I'll be a woman today and a man tomorrow." Any research into said individual would reveal him to be a fraud pretty much immediately.

You would immediately be called out as a fraud and arrested.

But the authorities might be reluctant to do any research into the individual for fear that they get in trouble for discrimination/being insensitive and getting sued.

Who would dare say that they don't believe that someone is transgender and that they are faking? They would just have to take the person's word that they are in the women's bathroom legitimately.

Plus, as some of us keep pointing out, whether or not you're allowed to be in a certain bathroom isn't really relevant if you're ducking under the stall to look at people's genitals.

Too risky to call someone out as a fraud. What if that person wasn't a fraud? Now the one doing the calling out would be in big trouble.

Better to just trust that the person is in the women's bathroom legitimately.

You don't know what goes on in women's bathrooms in a bar with drugs and alcohol flowing I guess. Not all bathrooms in all locations and all situations are used the same.

Some women in certain situations (at a bar with a lots of drunk females for example) can get a little promiscuous outside the stall, while still in the bathroom thinking that they are safe from men's eyes.

This is just hypotheticals on top of hypotheticals. Like the logic of opposing gay marriage because frat dudes might abuse it to pull off tax fraud.

No it's not a hypothetical. I have partied a lot. I know women at bars who have gone into a bathroom with their friends and changed clothes with them. I had a girlfriend who spilled a drink on herself and had some extra clothes in her car and went into the bathroom and changed. Not in the stall (stalls were taken)

If you really think that at every restroom women simply go into it and go into a stall and potty and then leave and the only possible way to see some skin is to look under a stall wall then I think you are a bit naive.
 
But this isn't even an issue. As JazzGal said, random public bathrooms(which is what you're talking about Fish) have always been used in the way we're talking about. People go into wherever they feel they belong. There are no penis checks either way. As much as that freaks you out, it happens all the time. You've likely been in a bathroom with someone who was born biologically female and you had no idea. The issue is workplaces or schools or similar settings. Where everyone knows you and you cannot go into a bathroom without people knowing who you are and what gender you are/identify with. Those are the places you hear about and that's what laws are aimed at. So you can use whichever bathroom you feel comfortable with and not get fired/expelled/whatever for it.

And no, I really don't think it's very likely that Joe Perv from accounting will start publicly identifying as a woman and coming to work in drag just so he can check out Sally from HR in the bathroom.

Because if you allow penis into women's bathrooms then everyone is now allowed in there. All men and all women. I can put on a wig and lipstick and a dress and go in there if I feel like it if you allow penis in there.
